Terms and Conditions
PART 1 – INTRODUCTION
1.1 About These Conditions
These Terms and Conditions (“Conditions”) govern your use of the booking services provided by Towcester Racecourse (“the Racecourse”, “we”, “us”, “our”) and your attendance at our venue. They form a legally binding agreement between you and us. Please read them carefully before making a booking or attending the Racecourse.
These Conditions apply to all bookings made online, by telephone, in person, or through any third-party platform authorised by us. By completing a booking or entering the Racecourse, you confirm that you have read, understood, and agreed to be bound by these Conditions in their entirety.
Where you are making a booking on behalf of other guests, it is your responsibility to ensure all members of your party are aware of and comply with these Conditions. You accept personal responsibility for the conduct of all guests in your booking.
1.2 Who We Are
Towcester Racecourse is operated by Orchestrate Limited, a company registered in England and Wales with registered company number 02880114 whose registered address is 5 Margaret Road, Romford, Essex, England, RM2 5SH. Any queries regarding these Conditions should be directed to us via info@towcester-racecourse.uk during Business Hours (9am–5pm, Monday to Friday, excluding public holidays).
1.3 Changes to These Conditions
We reserve the right to amend these Conditions at any time. Updated Conditions will be published on our website and will apply to all bookings made after the date of publication. Bookings already confirmed will be governed by the Conditions in force at the time of booking, unless otherwise required by law.
You should check our website before each visit to ensure you have read the most current version.
1.4 Governing Law
These Conditions and any contract formed under them are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
PART 2 – BOOKINGS AND PAYMENT
2.1 Making a Booking
A booking is only confirmed once we have received full payment and issued a written booking confirmation to you. No contract exists between us until this confirmation has been issued. We reserve the right to decline any booking at our absolute discretion, without being required to provide a reason.
Booking confirmations will be sent to the email address provided at the time of booking. It is your responsibility to ensure the contact details you provide are accurate. We accept no liability for non-receipt of confirmation due to inaccurate contact details or email filtering.
2.2 Payment
Full payment is required at the time of booking for all online bookings. For telephone bookings, full payment is required on the day the booking is made, unless otherwise agreed in writing by us. All charges are payable in pounds sterling and include applicable VAT.
We accept payment by the methods specified on our website at the time of booking. We reserve the right to cancel any booking where payment is not received in full and on time.
2.3 Pricing Accuracy and System Errors
This clause is important. Please read it carefully. We take all reasonable steps to ensure that our pricing and booking systems are accurate at all times. However, technical faults, system errors, or administrative mistakes may occasionally result in incorrect pricing or packages being made available that were not intended.
In the event that a ticket, package, or add-on is purchased as a direct result of a pricing or system error on our booking platform, we reserve the right to take any of the following actions:
- Cancel the booking and issue a full refund of any charges paid; or
- Contact you to offer an alternative booking of equivalent or greater value at the correct price; or
- Where it is operationally practicable and we choose to honour the booking, admit you on terms we specify.
We will notify you of any error and our proposed course of action as soon as reasonably practicable. Where we elect to cancel a booking under this clause and issue a full refund, entry to the Racecourse for that booking will not be permitted under any circumstances. The issue of a full refund discharges our obligations to you entirely in relation to that booking.
We shall not be liable for any loss, cost, inconvenience, or expense arising from a booking made as a result of a system or pricing error. Our liability is limited strictly to a refund of sums paid by you.
The existence of an order reference, payment receipt, or booking confirmation does not, in itself, constitute acceptance of a booking where a demonstrable system or pricing error has occurred.
2.4 Package Inclusions
Packages may include food, drinks, tote betting credits, or other inclusions as specified at the time of booking. Inclusions are subject to availability and may be substituted with items of equivalent value. Package inclusions are non-transferable, have no cash value, and cannot be carried over to future events.
Where a booking includes alcohol, it is your responsibility to ensure that all members of your party are aged 18 or over. We reserve the right to request proof of age at any point and to withdraw alcohol inclusions where we are not satisfied that the conditions for service are met, without refund.
PART 3 – CANCELLATIONS, AMENDMENTS AND REFUNDS
3.1 Cancellation by You
All cancellation requests must be submitted in writing to us at info@towcester-racecourse.uk. Cancellations are subject to the following policy:
- More than 30 days before the event: full refund of charges paid.
- Between 21 and 30 days before the event: 50% refund of charges paid.
- Fewer than 21 days before the event: no refund will be given.
Where individuals within a group booking drop out fewer than 21 days before the event, no refund or credit will be issued for those individuals. We are unable to transfer bookings to a different date within this period.
3.2 Amendments by You
Requests to amend a booking (including changes to dates, package type, or party size) must be made in writing at least 21 days before the event and are subject to our approval and availability. We reserve the right to charge an administration fee for amendments. Amendments within 21 days of the event cannot be guaranteed and may be treated as a cancellation under clause 3.1.
3.3 Cancellation by Us
We reserve the right to cancel or materially alter any event due to circumstances including but not limited to: changes to the race programme, severe weather conditions, power failure, major equipment failure, or any other cause beyond our reasonable control (Force Majeure).
Where we cancel an event entirely, we will offer you the choice of:
- A full refund of charges paid; or
- A transfer to an alternative date of equivalent value, subject to availability.
Where four or more races are completed before an event is abandoned, we reserve the right to retain all charges and no refund will be due. Partial events (fewer than four races) will be treated in accordance with our reasonable discretion, taking into account the nature of the disruption.
We shall not be liable to you for any indirect losses arising from event cancellation, including travel costs, accommodation, or loss of earnings.
3.4 Minimum and Maximum Party Sizes
Packages and areas may be subject to minimum and maximum party sizes as specified at the time of booking. If your final party size falls below the minimum, we reserve the right to reassign your booking to an area appropriate for your group size or, at our discretion, to charge for the minimum number. Where party size exceeds the maximum permitted, we will use reasonable endeavours to accommodate additional guests but are under no obligation to do so.
PART 4 – ENTRY, TICKETS AND ACCESS
4.1 Right of Entry
Entry to the Racecourse is at our absolute discretion. Possession of a valid ticket or booking confirmation does not guarantee entry if you are in breach of these Conditions or if we otherwise have reasonable grounds to refuse entry. We reserve the right to refuse entry to or eject any person from the Racecourse at any time, without prior notice and without being required to provide a reason, in the interests of safety, compliance, or the comfort of other attendees.
No refund will be given where entry is refused due to breach of these Conditions, including but not limited to: failure to comply with the dress code, intoxication, aggressive or disruptive behaviour, or refusal to comply with the reasonable instructions of our staff or stewards.
4.2 Tickets
Tickets remain our property until used for entry. All tickets are personal to the individual named on the booking and may not be transferred, resold, or used for any commercial purpose without our prior written consent. We reserve the right to void any ticket that we reasonably believe has been transferred or resold in breach of these Conditions.
Lost or stolen tickets will not be replaced as a matter of course. Any replacement is at our sole discretion and may be subject to an administration fee. We accept no liability for lost, stolen, or counterfeit tickets.
4.3 Access and Facilities
Entry to the Racecourse does not guarantee access to any specific area, building, or facility. We reserve the right to restrict or close areas of the Racecourse at any time on grounds of safety, capacity, or operational necessity.
Attendees must remain within the areas designated for their ticket or package type and must not enter restricted or private areas. Stewards’ instructions must be followed at all times.
4.4 Search
We reserve the right to conduct searches of persons and their belongings upon entry or at any point whilst on the Racecourse. Refusal to submit to a search will result in denial of entry or ejection from the Racecourse. No refund will be given in these circumstances.
PART 5 – CONDUCT AND BEHAVIOUR
5.1 General Standards of Conduct
All attendees are expected to behave in a safe, respectful, and lawful manner at all times. We reserve the right to eject any person whose behaviour, in our reasonable opinion, is:
- Threatening, abusive, violent, or likely to cause distress to others;
- Excessively intoxicated or under the influence of drugs;
- In breach of any applicable law or regulation;
- Likely to disrupt the enjoyment of other attendees;
- Likely to compromise the safety of people or animals on the Racecourse.
Ejected attendees will not be entitled to a refund of any charges paid.
5.2 Prohibited Items
The following items are prohibited on the Racecourse and will be confiscated or refused entry:
- Alcohol purchased off-site (unless specifically permitted in writing)
- Glass bottles, cans, or breakable containers
- Weapons or items that could be used as weapons
- Illegal substances
- Remote-controlled drones
- Fireworks, flares, laser pens, or smoke canisters
- Offensive signage, banners, or materials
- Any other item we reasonably deem to present a risk to safety or good order
We reserve the right to confiscate prohibited items without compensation. Confiscated alcohol may, at our discretion, be stored for collection upon departure, or disposed of.
5.3 Dress Code
A smart casual dress code applies across the Racecourse. Specific events or areas may require a more formal standard of dress, which will be communicated in advance. We reserve the right to refuse entry to any area where a dress code applies and the individual is not appropriately dressed. Offensive or inappropriate fancy dress is prohibited.
5.4 Children and Minors
Children under the age of 16 may enter the Racecourse free of charge when accompanied by a paying adult. Children must remain under adult supervision at all times. Children under 18 are strictly prohibited from:
- Placing tote bets or participating in any betting activity;
- Accessing betting or gaming facilities;
- Consuming alcohol.
Packages that include alcohol or tote betting are available to adults aged 18 and over only. We operate a Challenge 25 policy. Any person who appears to be under 25 may be asked to produce valid photo ID (passport, driving licence, or PASS-approved proof of age card) before being served alcohol or permitted to bet. If satisfactory ID cannot be produced, service will be refused and no refund will be given.
PART 6 – FOOD, DRINK AND RESPONSIBLE SERVICE
6.1 Food and Drink
Food and drink may only be consumed in designated areas. Attendees may not bring their own food onto the Racecourse without prior written consent. Alcoholic drinks purchased on the Racecourse may not be taken off-site.
6.2 Responsible Service of Alcohol
We are committed to the responsible service of alcohol. We reserve the right to refuse service to any person who appears to be intoxicated, regardless of age. Any person refused service on these grounds will not be entitled to a refund. We operate in accordance with our premises licence conditions at all times.
PART 7 – MEDIA, PHOTOGRAPHY AND INTELLECTUAL PROPERTY
7.1 Personal Use
Attendees may use personal mobile devices to take photographs and record video for private, non-commercial use only. Any images or recordings must not be shared with or transmitted to any third party for commercial purposes.
7.2 Restrictions on Race Material
No attendee may capture, record, transmit, stream, or publish any Race Material (including race footage, betting data, results, or track information) without our prior written consent or an appropriate licence. Any unauthorised recording or transmission constitutes a breach of these Conditions and may infringe our intellectual property rights.
7.3 Consent to Photography
By entering the Racecourse, all attendees consent to being photographed or recorded by us or our authorised partners for purposes including broadcast, marketing, and promotional use. Adults accompanying minors consent on their behalf. If you do not wish to be photographed, please notify a member of staff on arrival.
7.4 Intellectual Property
All content on the Racecourse, our website, and marketing materials is owned by or licensed to us and is protected by copyright and other applicable laws. Attendees may not reproduce, distribute, or exploit any such content without our prior written consent.
PART 8 – LIABILITY AND INDEMNITY
8.1 Our Liability
Nothing in these Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
Subject to the above, our total liability to you under or in connection with these Conditions shall not exceed the total charges paid by you for the booking in question. We shall not be liable for:
- Any indirect, consequential, or special losses;
- Loss of profit, revenue, or anticipated savings;
- Loss or damage to personal property (except where caused by our negligence);
- Any loss arising from events outside our reasonable control.
8.2 Your Liability
You are responsible for any loss, damage, or expense caused to us, our staff, other attendees, or the Racecourse by you or members of your party during or arising from your visit. You agree to indemnify us in full against any such loss, damage, or expense.
8.3 Personal Property
We accept no responsibility for the loss, theft, or damage to personal property brought onto the Racecourse. All personal property is brought onto the Racecourse entirely at your own risk.
8.4 Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Conditions where such failure or delay results from events outside our reasonable control, including but not limited to acts of God, fire, flood, severe weather, government action, pandemic, power failure, or industrial action. In such circumstances, we will endeavour to notify you as soon as practicable and to offer an alternative where possible.
PART 9 – COMMERCIAL ACTIVITY AND UNAUTHORISED USE
9.1 Prohibition on Commercial Activity
No attendee may conduct any commercial activity on the Racecourse without our prior written consent. This includes (but is not limited to): selling or distributing goods or materials, operating gambling or betting services, capturing or reselling race data, and any form of advertising or promotion not authorised by us.
9.2 Enforcement
We reserve the right to confiscate any equipment or materials used in connection with unauthorised commercial activity and to eject the individual involved. We may also pursue civil or criminal remedies as appropriate.
PART 10 – THIRD-PARTY OPERATORS
10.1 Independent Operators
The Racecourse may host a range of third-party operators on-site, including but not limited to: caterers, on-course bookmakers, bar operators, traders, stallholders, and contractors (each a “Third-Party Operator”).
Third-Party Operators are independent businesses. They are not employees, agents, or representatives of Towcester Racecourse, and they do not act on our behalf. Each Third-Party Operator is solely responsible for:
- The goods and services they provide;
- Compliance with all applicable laws, regulations, and licensing requirements relevant to their operation;
- Holding appropriate public liability insurance and any other insurance required for their activities.
10.2 Our Responsibility
Towcester Racecourse accepts no responsibility or liability for the acts, omissions, goods, or services of any Third-Party Operator on-site. Any complaint or claim arising from your interaction with a Third-Party Operator should be directed to that operator directly.
The presence of a Third-Party Operator on the Racecourse does not constitute an endorsement by us of their goods, services, or business practices. We do not warrant the quality, safety, or suitability of any goods or services provided by Third-Party Operators.
10.3 Your Contract with Third-Party Operators
Where you purchase goods or services from a Third-Party Operator, your contract is with that operator and is governed by their own terms and conditions. We are not party to any such contract and accept no liability arising from it.
PART 11 – PARKING AND VEHICLES
All vehicles parked on the Racecourse are parked entirely at the owner’s risk. We accept no liability for damage to, or theft from, vehicles on our premises. Vehicles must be parked only in designated areas and in a manner that does not obstruct access routes. We reserve the right to clamp or remove any vehicle parked in breach of these requirements at the owner’s cost.
PART 12 – ANIMALS
With the exception of guide, assistance, or therapy dogs, and animals involved in racing, no animals are permitted on the Racecourse without our prior written consent. Where dogs are permitted, they must be kept on a lead at all times and must not foul any part of the Racecourse. Owners are responsible for the behaviour of their animals at all times.
PART 13 – GENERAL PROVISIONS
13.1 Entire Agreement
These Conditions, together with any booking confirmation and applicable package descriptions, constitute the entire agreement between us and you in relation to your booking and attendance. They supersede all previous agreements, representations, and understandings.
13.2 Severability
If any provision of these Conditions is found to be unlawful, invalid, or unenforceable, that provision shall be deemed severed and the remainder of these Conditions shall continue in full force and effect.
13.3 No Waiver
Failure by us to enforce any provision of these Conditions at any time shall not constitute a waiver of our right to enforce that provision or any other provision in the future.
13.4 Third Party Rights
These Conditions do not confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
13.5 Notices
Any formal notice to us under these Conditions should be sent in writing to 5 Margaret Road, Romford, Essex, England, RM2 5SH or by email to info@towcester-racecourse.uk. Notices sent to you will be sent to the contact details provided at the time of booking.
13.6 Consumer Rights
Nothing in these Conditions affects your statutory rights as a consumer under applicable UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
